Terms of Service

Welcome to Streamable ("Streamable," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of our website, dashboard, cloud-hosted OBS instances, streaming network, APIs, and related services (collectively, the "Service"). By creating an account, clicking "I agree," or accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

Please read carefully. Section 15 contains a binding individual arbitration agreement and class action waiver for users in the United States.

  1. Streamable Service

    Streamable provides managed streaming infrastructure, including remote GPU servers, drop-protection screens, ingest and output routing (SRT), multi-destination streaming, and cloud-hosted OBS controls that you and your team can access through the web. We are a managed transport and control service—not a streaming destination or public broadcaster. Your content is delivered only to the destinations you choose.

    Any roadmap, beta, or pre-release features (including drop protection, clips playback, and collaborative controls) are provided on an experimental basis and may change, be limited, or be withdrawn at any time.

  2. Eligibility and Accounts

    You must be at least the age of majority where you live (18 in most U.S. states) and able to form a binding contract. By using the Service, you represent that you meet these requirements and that your registration information is and will remain accurate. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at team@streamable.run if you suspect unauthorized access.

  3. Billing and Subscriptions

    Certain features require payment of fees in U.S. Dollars. Paid subscriptions renew automatically each billing cycle until canceled. We currently use Stripe, Inc. and its affiliates to process payments; by purchasing a plan, you also agree to the applicable Stripe terms. You authorize us and our payment processor to charge your payment method for recurring charges, taxes, and any agreed usage-based fees (including overages) until you properly cancel. You remain responsible for all charges through the end of the then-current billing period.

    Prices, plan features, and limits may change on notice to you through the Service or by email. Except where required by law, all fees are non-refundable and not subject to credit or proration (including for partial periods, downgrades, unused resources, or feature changes). Any refunds we choose to offer are discretionary one-time credits, not waivers of this policy. If we cannot collect fees when due, we may suspend or terminate access to the Service.

  4. Payments and Payouts

    Payments to Streamable and payouts from Streamable may be processed under PEAR CREATIONS, INC., the parent company and legal entity for Streamable. You may see PEAR CREATIONS, INC. on bank statements, card statements, Stripe-hosted pages, tax forms, payout records, and related payment communications.

    Payout features, including affiliate, referral, Upload Corner, and other creator monetization payouts, are subject to eligibility, identity and tax verification, payment processor requirements, payout thresholds, country availability, and compliance review. We may delay, withhold, offset, reverse, or decline payouts for fraud, chargebacks, refunds, duplicate activity, policy violations, legal compliance, or suspected abuse. You are responsible for taxes, bank fees, currency conversion, and accurate payout information.

  5. Acceptable Use and Streaming Content

    You are solely responsible for the content you stream, upload, record, or route through the Service and for ensuring that your use complies with all laws and third-party policies (including the terms of Twitch, YouTube, Kick, X, or any other platform you connect). Do not use the Service to transmit unlawful, infringing, harassing, harmful, or deceptive content; to violate intellectual property or privacy rights; to send unsolicited commercial communications; to interfere with or test the security of the Service; or to attempt to gain unauthorized access to any system.

    You retain ownership of your content. By using the Service, you grant Streamable a limited, non-exclusive license to host, process, transmit, and display your content as described in these Terms and as reasonably necessary to operate, secure, improve, and support the Service.

  6. Video Recording and Service Data

    If you enable recording, clips, playback, Upload Corner, drop protection, troubleshooting, or related features, the Service may receive, buffer, record, store, transcode, process, analyze, display, and transmit video, audio, metadata, configuration, usage, payout, and other data you provide to or generate through the Service ("Service Data").

    You retain any rights you have in your Service Data. You grant Streamable and PEAR CREATIONS, INC. a worldwide, non-exclusive, royalty-free license to use, host, reproduce, process, transmit, display, create technical derivatives of, and otherwise handle Service Data as reasonably necessary to provide, maintain, secure, support, troubleshoot, and improve the Service; comply with law; enforce these Terms; and protect Streamable, users, and third parties.

    Streamable is not responsible for reviewing Service Data before it is streamed, recorded, uploaded, processed, or shared. You are responsible for obtaining all rights, permissions, and consents required for your content and data, including from people who appear or can be heard in it.

  7. Third-Party Services and Destinations

    The Service may integrate with or depend on third-party services (e.g., streaming platforms, cloud infrastructure, payment processors). We are not responsible for third-party services, their security, or their availability. Your use of those services is governed by their terms, and you must keep your own third-party accounts in good standing.

  8. Data, Privacy, and Security

    We process configuration data, account details, usage data, and streaming signals as needed to provide the Service (for example, to run your streams through our infrastructure, trigger drop-protection screens, and display dashboards). Please review our Privacy Policy for details on how we collect, use, and share information. You acknowledge that internet transmission and cloud services have risks; we cannot guarantee that unauthorized third parties will never defeat our security measures.

  9. Service Changes and Availability

    We aim to provide reliable streaming infrastructure, but the Service (including drop protection) may be unavailable, degraded, or limited due to maintenance, capacity constraints, network issues, or events beyond our control. We may modify or discontinue features at any time without liability. If we materially reduce core paid features, we will provide notice. We do not guarantee error-free or uninterrupted operation and do not provide service credits or refunds for downtime or feature unavailability.

    The Service is not designed for safety-critical or emergency uses. You are responsible for maintaining your own backups and redundancies for critical content and configurations.

  10. Intellectual Property

    The Service, including its software, interfaces, trademarks, and content, is owned by Streamable or its licensors and is protected by intellectual property laws. We grant you a revocable, limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Except for the license expressly granted to you, Streamable reserves all rights.

  11. Termination and Suspension

    You may stop using the Service at any time and may cancel paid plans through your account settings. We may suspend or terminate access immediately for violation of these Terms, non-payment, fraud, or risk to the Service or others. Upon termination, your right to use the Service ends, and certain Sections (including those on fees owed, indemnity, ownership, disclaimers, limitations of liability, dispute resolution, and miscellaneous terms) will survive.

  12. Indemnification

    To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Streamable, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, losses, and expenses (including attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or of any law or third-party right.

  13. Disclaimers

    The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content will be preserved without loss.

  14. Limitation of Liability

    To the fullest extent permitted by law, Streamable will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service is limited to the amount you paid to Streamable for the Service in the three (3) months before the event giving rise to liability or one hundred U.S. dollars ($100), whichever is greater. These limitations apply to the maximum extent permitted by law.

  15. Dispute Resolution and Arbitration

    For U.S. users: You and Streamable agree to resolve disputes through binding individual arbitration and not in court. You waive any right to participate in class actions or class arbitrations. Either party may seek relief in small claims court for qualifying claims.

    Arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or, if applicable, its Consumer Arbitration Rules) in San Francisco, California, unless we both agree to a different location or to remote proceedings. This Section does not prevent either party from seeking injunctive relief to protect intellectual property or to prevent unauthorized access to the Service. If the class action waiver is found unenforceable, this entire Section will be unenforceable.

  16. Miscellaneous

    These Terms constitute the entire agreement between you and Streamable regarding the Service and supersede all prior or contemporaneous understandings. We may update these Terms by posting a revised version with a new "Last updated" date; continued use of the Service after the update constitutes acceptance. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. If any provision is found unenforceable, the remaining provisions will remain in effect. These Terms are governed by the laws of the State of California, excluding its conflict of laws rules, and subject to the arbitration terms above. Notices may be sent to you at the email associated with your account and to us at team@streamable.run.
